A. Terms of Service      

Welcome to AllStudentRentals.com. All Rental Network, Inc. (“the Company) provides its services to you through www.AllStudentRentals.com (the “Site’) subject to the following terms of service and conditions (“Agreement”). If you visit or shop at the Site, you accept these conditions. Please read them carefully. In addition, when you use any current or future Site service you also will be subject to the guidelines and conditions applicable to such service or business. If you do not accept all of the terms and conditions of this Agreement, you are prohibited from using the Site or any Company services.
Site Overview
The Site operates as a web site design and information resource service for various subscribed businesses, including, without limitation, posters and property managers (the "Clients"). The information supplied by the Clients is assumed to be accurate, and the Company assumes no responsibility or liability of any kind regarding any choices made or not made by the Clients, the actions of any services used or not used by the Clients, or any changes in the nature, price structure, business status, or any other characteristic of any individual service provided by the Company.
License and Site Access
The Company grants you a limited license to access and make personal use of this Site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of the Company. This license does not include any resale or commercial use of this Site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this Site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This Site or any portion of this Site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of the Company. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Company and our affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilizing the Company’s name, the Site’s name or trademarks without the express written consent of the Company. Any unauthorized use terminates the permission or license granted by the Company. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the Site so long as the link does not portray the Site, the Company, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Company or Site logos or other proprietary graphic or trademark as part of the link without express written permission of the Company. The privilege to access and use the Site's services is personal to the user and is not transferable to any other person or entity.
Your Account
If you use this Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.
Comments, Communications, and Other Content
Visitors may post properties, comments, and other content; send e-mail and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, violating fair housing laws, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. The Site reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.
If you do post content or submit material, and unless we indicate otherwise, you grant the Company and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant the Company and its affiliates and sub-licensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this Agreement and will not cause injury to any person or entity; and that you will indemnify the Company or its affiliates for all claims resulting from content you supply. The Site has the right but not the obligation to monitor and edit or remove any activity or content. The Site takes no responsibility and assumes no liability for any content posted by you or any third party.
Billing
The customer is responsible for all billing related to their listing(s).  By agreeing to AllStudentRentals.com terms of service and listing your property you hereby acknowledge that you will pay for every qualified leads generated by AllStudentRentals.com. A qualified lead is either an email or a phone call lasting longer than 45 seconds, tracked by our call tracking software. You will not be charged for duplicate leads from the same email or phone number for each property per month. You will be billed for all your leads on the 20th of every month and payment must be received by the 1st of the following month. Payment amounts more than 30 days past due will accrue interest at a rate of 1.5% per month.  You will also be responsible for any collection and legal fees reasonably incurred by us in collecting amounts due to us.
Equal Opportunity Housing
All real estate advertised on the Site is subject to the Federal Fair Housing Act, which makes it illegal to advertise any preference, limitation or discrimination based on race, color, religion, sex, handicap, familial status, or national origin, or intent to make any such preferences, limitation, or discrimination. The Company will not knowingly accept any advertising for real estate which is in violation of the law. All persons are hereby informed that all dwellings advertised are available on an equal opportunity basis.
Disclaimer of Warranties
The Company  does not warrant the completeness, timeliness or accuracy of any of the listings and/or other information and data contained on the Site and may make changes thereto at anytime in its sole discretion without notice. Further, all listings and other information conveyed hereby are provided to users "AS IS" and should be verified independently with the respective posters or property managers. In no event shall the Company  be liable for any damages of any kind related to the use or misuse of information provided hereby.
The Company  disclaims all warranties whether express or implied in respect of the information (including listings and software) provided hereby, including the implied warranties of fitness for a particular purpose, merchantability, and non-infringement.
The Company cannot and does not guarantee or warrant that files available for downloading through any particular site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.
Except for information, products or services clearly identified as being supplied by the Company, (i) the Company does not operate, control or endorse any information, products or services on the Site in any way; (ii), all information, products and services offered through the Site generally are offered by third parties that are not affiliated with the Company; (iii), the Company does not operate, control or endorse any information, products or services on the Site in any way; (iv) all information, products and services offered through the Site generally are offered by third parties that are not affiliated with the Company.
Limitation of Liability
IN NO EVENT SHALL COMPANY, ITS SUPPLIERS, AND REFERRAL PARTNERS OR ANY OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR CONTENT OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND OR NATURE, WHETHER FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), MISPRESENTATION, STRICT LIABILITY OR ANY OTHER LEGAL OR EQUITABLE THEORY, ARISING FROM DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE, THE SERVICES, FORMS, CONTENT OR YOUR PERSONAL COMPUTER AND OTHER TECHNOLOGY INCLUDING, WITHOUT LIMITATION, LOST SALES, LOST REVENUE, LOST PROFITS OR OTHER LOSS OF BUSINESS, LOSS OF OR DAMAGE TO DATA, OR COST OF SUBSTITUTE SERVICES EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnity
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND AFFILIATES HARMLESS FROM ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, COSTS AND EXPENSES, INCLUDING REASONABLE ATTORNEYS' FEES, IN ANY WAY ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR YOUR VIOLATION OF THIS AGREEMENT.
Intellectual Property and Copyright
All content included on this Site, such as text, graphics, logos, button icons, images, and software, is the intellectual property of the Company or its content suppliers and, as applicable, protected by United States and international copyright laws. All software used on this Site is the property of the Company or its software suppliers and protected by United States and international copyright laws.
Trademarks
The Site, AllStudentRentals.com, the Company and all related graphics, logos, page headers, button icons, scripts, and service names are trademarks or trade dress of the Company or its subsidiaries. The Company’s trademarks and trade dress may not be used in connection with any product or service that is not the Company’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits the Site or the Company. All other trademarks not owned by the Company or its subsidiaries that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by the Company or its subsidiaries.
Copyright Complaints
The Company and its affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, contact us immediately.
Profanity
The Company prohibits the use of language that is racist, hateful, sexual or obscene in nature. This includes but is not limited to; offensive user names, email addresses, property ad content and pictures.
Photos
The Company prohibits the use of photos that are racist, hateful, sexual or obscene in nature in a public area. It is strictly prohibited to copy, reproduce or reuse any photographs or images from this Site.
False Contact Information
The Company prohibits falsifying or omitting your name, address, and/or telephone number (including use of fax machines or disconnected numbers). Disciplinary action may result in the indefinite suspension of a landlord's account, temporary suspension, or a formal warning. Applicable Law
By visiting the Site, you agree that the laws of the state of California, without regard to principles of conflict of laws, will govern this Agreement and any dispute of any sort that might arise between you and the Company or its affiliates.
Disputes
Any dispute relating in any way to your visit to the Site or to products you purchase through the Site shall be submitted to confidential arbitration in Chico, California, except that, to the extent you have in any manner violated or threatened to violate the Company’s intellectual property rights, the Company may seek injunctive or other appropriate relief in any state or federal court in the state of California, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this Agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
Site Policies, Modification, and Severability
Please review our other policies, such as our privacy policy posted on this Site. These policies also govern your visit to the Site. We reserve the right to make changes to our Site, policies, and this Agreement at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

All Rentals Network Inc (the "Company") strives to ensure the highest standards for property listings and customer information privacy. Please review the following policy (“Privacy Policy”) to learn about our company practices and policies. Please be aware that our Privacy Policy is subject to change at any time.
Purpose
This Privacy Policy  provides information on how the Company uses your personal information. By agreeing to the Privacy Policy, you agree to our collection and use of your personal information as described in the Policy. This Privacy Policy is effective for all users of the Site.
Personal Information
You can browse some areas of www.AllStudentRental.com ("the Site") without being a registered user. However, certain activities do require registration. You consent to the transfer and storage of your information by registering with The Site. We may collect and store the following personal information:

• Name, email, address, telephone number, and (depending on the service used), move-in dates;
• Transactional information (such as lease terms, lease parties);
• Computer sign-on data, statistics on page views, and traffic to and from the Site; and

DISCLAIMER: By requesting contact information for any and every property on the Site you consent to allowing the Company to transfer your first name, email, and/or phone number, and message to the property manager or landlord or other entity listed for that property. By using the Site and calling any and/or every property using our toll free 866-659-4494 you consent to allowing the Company to transfer your caller identification number to the property manager or lanlord or other entity listed for that property.
Use of Information
Our primary purpose in collecting personal information is to provide you with a safe and user-friendly experience. For example, the Company may use your personal information to:

• Improve our services and the Site's content and layout;
• Provide the services and necessary customer support you request;
• Resolve disputes, collect fees, and troubleshoot problems;
• Track and record customer satisfaction with our services;
• Protect the Company against error and fraud;
• Inform you of special promotions and announcements;
• Enforce our agreements, terms, conditions, and policies; and
• As otherwise described to you at the time of collection.

We may occasionally ask you to complete optional surveys. These surveys are used to improve and customize your experience with the Site.
The Company always provides you the ability to opt-out of further communication such as promotions and surveys; see the Opt-Out section below.
The Company does not share any of your personal information with outside organizations, companies, individuals, etc. The only exception to this standard is if such a disclosure is reasonably necessary to respond to any and all legal processes.

The Company may place a small cookie on your computer's hard drive.  This allows us to personalize your use on the Site.  In order to maximize the functionality and usability of the Site, you must set your browser's preferences to allow both permanent and temporary cookies.
Changing Your Personal Information
Should your personal information change, please immediately update your information on the Site. This will ensure the accuracy of our records. The Company does retain personal information from closed accounts in order to comply with law and collect and disburse any fees owed.
Third Parties
This Privacy Policy addresses only the use of information we collect from you. Since the Company does not control the privacy policies of third parties, you are subject to the privacy policies of those third parties. It is advisable that you consult with the management of third parties before you disclose your personal information to others.
